My Lords, I thank my noble friend for her intervention. Let me have another go at explaining it. The code is not in itself a statute. Once you

go down the route of having a code and not a statute, you effectively have a framework that is still a legal framework—it is still legal guidance that gives people rights. The code says that you have 12 rights and lists them: this is what the authorities have to do and this is what you do if those rights are not observed. It is a legal framework; we are talking about degrees of legal right, but these are legal rights. If you wanted to, you could go to court and say that you have not had them.
