I can tell the noble Baroness that the “particular regard” element is actually in relation to the Secretary of State’s duty. It is to say that she must have particular regard to the duties under freedoms of speech. The difference between due and particular in this context is that the latter, in all cases, elevates the freedom of speech consideration among all the considerations that must be borne in mind, whereas specifying that due regard must be had to a factor simply underscores the importance of that factor while

leaving the degree to which it must be elevated by the specified authority to be determined by the circumstances of the case.
