European Union (Croatian Accession and Irish Protocol) Bill

Applying the amendment to line 7 on page 1 of the Bill would make it say that the accession treaty would be approved,

“except for those provisions requiring the full application”.

It would, therefore, be a conditional approval of the treaty and I do not believe that the European Court of Justice could rule us in breach of treaty obligations, because Croatia would not have them until the treaty was ratified under our normal constitutional procedures,

which, thanks to the European Act 2011—which the Minister presided over—require an Act of Parliament that is unqualified.
