My Lords, the purpose of the amendments in this group is to insert in Schedule 16 the proviso that the section does not apply if the defendant can show that his or her conviction was imposed outside England and Wales and resulted from a trial that would have, if the trial had taken place in England and Wales, breached Article 6 of the convention rights within the meaning of the Human Rights Act. We are concerned about the quality of justice in certain countries. The purpose of these amendments is to ensure that the courts can take into account the fact that a trial was in breach of Article 6 of the convention rights. I beg to move.
