Amendment 205A 205A: After Clause 158, insert the following new Clause— "Police retention of photographs (1) The Secretary of State must, as soon as possible and not later than three months after Royal Assent, amend Code D made under section 67(3) of the Police and Criminal Evidence Act 1984 (c. 60) (codes of practices—supplementary) as follows. (2) After article 3.3 insert— "3.4(a) Where an officer takes a photograph or photographs of an individual who has not been arrested or charged with any criminal activity, those photographs will not be retained for longer than 1 year, unless the subject of the photograph is subsequently charged and convicted with a crime. 3.4(b) This subsection applies to, but is not limited to, evidence gathered by Forward Intelligence Teams and other evidence gathering operations.""
