If the noble Lord, Lord Wedderburn, will be patient for a moment, I am trying to explain a complicated thing in a simple way. I am trying to explain that ASLEF, in this case, succeeded because of the over-reach in the legislation, but the court was careful to say that the individual would suffer no detriment other than loss of membership. My amendment is intended to—and there may be other ways of doing this—deal with that class of detriment.
