I, too, find subsection (2) rather sinister because it seems to encourage agent provocateurs. Subsection (3) would catch parents who bought a packet of cigarettes and who were seen later to offer one to his or her 17 year-old son or daughter. Surely that is not what the noble Lord, Lord Henley, intends; I would be interested to hear from him on that.
