First, it is clear from the authority that I cited that, despite what was said in February 1970 during the passage of that Bill, people did not expect the provisions to be used as they have been. Secondly, they had not anticipated the question of trying to exclude judicial review. Lastly, do not these provisions contain deeming arrangements that would be retrospective?
