The point that I am making is that the court must have regard to a number of matters. It has to have regard primarily to the aims of the youth justice system, so that that in itself is surely a distinguishing mark. Secondly, it must have regard to the purposes of sentencing mentioned in new Section 142A(4) and to Section 44 of the Children and Young People Act. That is surely what gives it its distinction.
