moved Amendment No. 44: 44: Clause 13, page 6, line 27, leave out ““unnecessary”” and insert ““disproportionate”” The noble Baroness said: I shall speak also to Amendments Nos. 45 to 47—this is a short point, I hope. I accept of course that the intention behind the clause is entirely benign, but I am not sure that I understand it. Burdens that are unnecessary may not be imposed, but how does that fit with requirements to be proportionate, which we see towards the end of the clause? That is a straightforward inquiry as to how subsections (1) and (3) can be reconciled. I beg to move.
