No, I do not accept that and I am happy to rely on the advice of the Library, which says that the new test is likely to be more generous to defendants. If one uses the words ““grossly disproportionate””, an objective test is the right approach. The Government are now advancing a different argument and suggesting that the Opposition seek a lower level of protection than the one that they propose. That is plainly nonsense.
