In the event that my hon. Friend’s amendment is passed and an airline subsequently refused to reimburse its customers regarding money that it had extracted from them on the basis that it needed to meet the tax liability imposed retrospectively by the Government, would it not be in a very weak position in the courts, having obtained money under entirely false pretences?
