My hon. Friend has been confronted with the ridiculous example of someone who murdered an old lady, but there is the much more relevant example of someone who killed a young lady; Private Clegg, who shot a woman at a roadblock and was convicted because the case was tried through the civil process of murder. That judgment was overturned only after two appeals, but if the case had been considered in a military context from the beginning, it might well never have gone to court.
