The noble Lord said: This provision in the Bill’s order-making powers seems to me to be unacceptably broad. We already have a series of powers vesting wide discretion in the Lord Chancellor. At subsection (1)(b) and (c) are powers that can apply in different cases or circumstances and those that can be limited in time. In addition, at paragraph (a) we are asked to approve the idea that a power can apply generally or only in specified circumstances. I believe that this is an unnecessary layer and an inappropriate message. As I said at our previous Committee sitting, we are trying to plug any gaps or loopholes, not create new ones. I beg to move.
