I find the European judgment somewhat obscure at present. If the Minister is right that the suggestions of the noble Lord, Lord Hunt, about what ought to be in the Bill are unnecessary because they will be covered elsewhere, it seems to me that making a specific obligation to encourage competition is also putting something that does not belong here on the face of the Bill. I can see that a regulator of this kind might, and probably should, be in a position to stop anything unlawfully anti-competitive, but encouraging competition goes well beyond that and might include taking positive steps to encourage new organisations to become claims management service providers. That is well outside the scope of what a regulator should do. I will wait with interest to see what the Minister comes up with after consulting the OFT.
