Compensation Bill [HL]

I am very grateful to the noble Lord. This is a rough and ready mechanism because, whatever words are chosen, some will be excluded. On reflection, perhaps a much wider wording might be better, so that we catch those whom we wish to catch and do not exclude that we have no wish to exclude. It may be helpful to the Minister if I quote from the policy director of the Claims Standards Council, Mr   Andy Wigmore, who said about those claims management companies:"““If they do their marketing offshore, then there is nothing that can stop them from breaking rules that would be applicable in the UK on acceptable advertising””." So it would be really helpful if the noble Baroness could concentrate on the point about advertising. Mr Wigmore continues:"““When they then pass compensation claims onto UK intermediaries, they are not breaking any laws, but it will make regulation harder to enforce. There is a big call centre in Fuengirola that these companies are using . . . These places are where a lot of spam e-mails and cold-calling phone calls originate””." So we are dealing with an actual problem in two specific places, but there may well be others.
