I am grateful to my noble friend for those comments and am sure that the noble Baroness will respond on her amendment. Yes, a fraud is a fraud and, wherever it came from, sooner or later, the court is entitled to say that a fraud is a fraud. Nevertheless, I accept that, as my noble friend has explained, there may be circumstances where those rights have been transferred from generation to generation and the court must have some discretion. I just do not like the word ““fair””, to be perfectly honest.
