As the owner of a common, I have had similar conversations with various clubs and they have assured me that they have informed their members that anyone who is contravening the law as it stands will not be welcome. The difficulty is that those individuals are not members of clubs at all and come up willy-nilly when they feel like it. The rules are there; the rules are in place. Those people are wantonly breaking the law. I am sorry to disagree with the noble Lord, but it is a police matter and the police are simply not dealing with it.
