I believe there is a small devolution issue here. While the Road Traffic Act is certainly reserved, road construction and road maintenance are distinctly devolved matters. How will the opportunity to create such areas, including the funding for them be transmitted when this is a piece of reserved legislation? The Scottish Executive, which has to operate the trunk roads in Scotland, would need a guarantee that additional funding would come from the Treasury.
