I find the Minister’s position very confusing. On the one hand, he is saying that in case law there is a presumption of a meaningful relationship between the parent and the child. We have argued whether there is that presumption in case law, but the Minister is approving that and saying that that is a good thing, while, on the other hand, resisting the proposition that statute law should reflect what he contends is contained in case law. In tandem with that, he is quoting sources that suggest that a presumption of any contact at all is a bad thing. What is his position? Is he saying that the Government are in favour of a presumption of contact? Is he saying that the Government are in favour of what case law has established, according to him? What is the position that the Government would like to see established by this Bill?
