I was very interested by what the noble Lord said. I do not support the two amendments as they are drafted, but there is a case for the view that some certainty on what will happen if the parents do not reach agreement can be a powerful incentive to parents to get their heads together. That is one of the principles of the Florida system. If the parents do not reach agreement, they know that a 30:70 or a 60:40 order will be imposed. However, if they reach agreement and the court considers that they have argued the case well and there is a reasonable case for an alternative arrangement, the solution that they have agreed is accepted.
