It would exclude such evidence; there is no doubt about that, and rightly so, because what the noble Lord is referring to
is evidence where the defence says, “Well, you say this in relation to this case, but what about this?” and then refers to another instance of sexual connection and says, “Look what you did there.” The purpose of the provision is to do exactly what the noble Lord, Lord Pannick, says.
