66G: Clause 35, page 28, line 36, at end insert—

“( ) A person is within this subsection if he or she has made a claim for asylum which has not yet been determined by the Secretary of State or has been refused and an appeal against that refusal is pending, and—

(a) “claim for asylum” has the same meaning as in section 94 of the Immigration and Asylum Act 1999 (interpretation of Part VI);

(b) an appeal is pending for the purposes of this subsection when it is pending under section 104 of the Nationality, Immigration and Asylum Act 2002 (pending appeal).”
