The following is an extract from the Tenth sitting of the Energy Public Bill Committee.

The clause contains a power for the Secretary of State to amend or modify the threshold for capacity in excess of which these measures can be applied. Capacity refers to the tonnage of oil that the

operator has handled in the previous calendar year. This would not change the person to whom the powers under this part could apply.

An error has been identified in my response to the debate on clause 243.
