The Minister is giving a pretty fair assessment of how he sees this proceeding. The new clause provides for a permissive power, meaning that it would simply be available going forward. The proposal has been mirrored in previous pieces of legislation, such as that dealing with Crossrail, so what is the Government’s objection to a permissive clause of this kind?
