5: Clause 25, page 15, line 28, at end insert— ““( ) In relation to a transfer to another public body or to any other body of functions, duties or powers under section 1 or 5, or to a merger (where such transfers are involved), under section 2, the Transfer of Undertakings (Protection of Employment) Regulations 2006 (S.I. 2006/246) shall apply to a transfer which relates to rights or liabilities under a contract of employment whether or not the transfer would, apart from this subsection, be a relevant transfer for the purposes of those regulations. ( ) In the case of an employee of a body whose functions, duties or powers are transferred or merged under section 1, 2 or 5— (a) a period of employment with the transferor is to be treated as a period of employment with the recipient organisation; (b) the transfer to the recipient organisation is not to be treated as a break in service.””
