I may be reading clause 10 incorrectly, but it seems to me to have precisely the opposite meaning to the one the hon. Gentleman suggests. It states that"““a school does not replace a maintained school if it provides education for pupils of a wider range of ages””," which means that it would be viewed as an additional school, and therefore that it comes under clause 10(2), which states:"““The Secretary of State must take into account what the impact of establishing the additional school would be likely to be on maintained schools, Academies and institutions…in the area””." As I said, the measure therefore appears to have the opposite effect to the one the hon. Gentleman suggests.
