3: Clause 1, page 1, line 11, at end insert— "( ) The duty referred to in subsection (1) shall be actionable in the courts. ( ) The court may make such order in relation to such an action (including an award of damages) as it considers appropriate. ( ) "The court" means— (a) the High Court or County Court, (b) in Scotland, the Court of Session or the Sheriff Court."
