Crime and Security Bill

Proceeding contribution from Gordon Prentice (Labour) in the House of Commons on Monday, 18 January 2010. It occurred during Debate on bills on Crime and Security Bill.
Why is it, then, that we have received a briefing from the Equality and Human Rights Commission, which will be aware of the research to which my friend has alluded, advising us that if my friend's proposals go through,""the Government is likely to be in breach of Article 8 of the Convention and be acting unlawfully"?" How come the commission has got it wrong?
