I am grateful to the hon. Gentleman for giving way, although we disagree about whether sexual orientation is the only issue here. However, does he agree that Mr. Justice Richards did not say in his judgment that the narrowing of the definition by the European Commission was necessarily the right way to go? Clearly it is a complicated judgement, but the High Court is at variance with the Commission, and that is why some of us question why the Commission's opinion is considered to be sacrosanct.
