My Lords, I am happy to support "must" over "may" for the eloquent reasons given. It is important that we signal clearly that we have an interest in what employers want. If there is an overall lack in the Bill, especially in relation to Ofqual, it is that insufficient overt mention is made of learners, learning and education. One way of dealing with this would be Amendment 237. Finally, it is immensely important that we clarify the issues raised by the noble Viscount, Lord Eccles, about how the Secretary of State would issue directions. I have long advocated the need for this to be done in the public arena so that it can be subject to the scrutiny of the community.
