My Lords, I wish to raise a point which I think is important to bear in mind. First, I support the Minister’s Amendment 62A, which encompasses matters that would involve the Court of Session in Scotland. I observe that Amendment 55C, which relates to Section 13(6) of the Tribunals, Courts and Enforcement Act 2007, does not engage the Court of Session and therefore is irrelevant so far as that court is concerned. The same point can be made with regard to the amendment tabled by the noble Lord, Lord Kingsland. The amendments that satisfy the matters concerning the Court of Session in Scotland are those which are raised by the amendment proposed by the noble and learned Lord, Lord Lloyd of Berwick, which is quite general and therefore is equally applicable to the Court of Session as it is to the Courts of Appeal in England and in Northern Ireland; likewise, Amendment 62A, proposed by the Minister. To that extent, I support the amendments.
