I would love to give way to the hon. Gentleman, but I have already taken a couple of interventions, and it would be unfair to others who are seeking to speak. The questions that the Government have to ask are manifold. Under which rules of procedure will admissibility of evidence be judged? Will it be judged under the rules of the jurisdiction through which it is obtained or those of the jurisdiction in which the trial will take place? The Bill is absolutely silent on that. I have no doubt that co-operation between Scotland and the rest of the UK could be improved, but it is not necessary to drive a coach and horses through the constitutional settlement and the position of Scots law in Scotland in order to do so. I hope that that point will be considered carefully when the Bill goes into Committee.
