moved Amendment No. 137: 137: Clause 40, page 17, line 3, at end insert ““subject to a maximum amount to be laid down in the order”” The noble Lord said: When we debated Clause 37, I, among others, raised the matter of the quantification of the maximum amount of the fixed penalty. The Minister told us in the debate on Amendment No. 112 that the criteria would be specified in an order subject to the affirmative procedure. That was helpful, even if it did not quite go all the way. I asked for the amount and he stated the criteria, which I agree might do the trick if they are sufficiently tightly drawn and clearly set down. Will he tell the Committee whether the criteria in respect of the disciplinary procedure will again be specified in an order that is subject to the affirmative procedure? If so, will we be able to see the draft wording at least of the criteria before Report? I move the amendment to allow him to respond. I beg to move.
