It may not be necessary for me to intervene here but it seems to me that there is a simple answer to the question asked by the noble Baroness, Lady Sharp. Clause 39(1) relates to Wales, and subsection (2) states: "““Otherwise the provisions of Parts 1 to 4, section 37 and the Schedule come into force on such day as the Secretary of State may by order appoint””."
So what triggers the operation of the section is the Order in Council.
