My hon. Friend will have observed that the Secretary of State referred to consultation and the like. Does it worry him that although clauses 7 and 8 provide for consultation, it will be only"““as the Secretary of State thinks appropriate in relation to the proposal””?"
Given the legal context and the fact that that is challengeable only by judicial review, will it not be extremely difficult to set up a case for such a review if the Secretary of State is allowed to make up her own mind on exactly what its parameters should be?
