The noble Lord said: I propose that we remove the part of new subsection (2ZB) regarding the duty to take into account guidance issued from a Secretary of State on protection or improvement of the environment. Paragraph (a) of the same subsection mentions that LTAs are, "““to take into account any policies””,"
issued on the subject. While it is understandable that local transport policies should take in environmental matters, I am uncertain why the Bill requires a separate mention of guidance issued by the Secretary of State. Surely taking into account government policy will suffice. Can the Minister envisage any circumstances in which policies might differ in these two areas to the guidance issued? I beg to move.
