My Lords, we are considering an amendment to paragraph 1(1)(a) of Schedule 1, which states, "““a chairman appointed by the Lord Chancellor with the concurrence of the Lord Chief Justice””." The amendment removes the concurrence of the Lord Chief Justice completely and there is no provision even for consultation on the topic. The chairman will be appointed without the Lord Chief Justice having any right to be consulted at all. I see the Minister shaking his head. Have I got it wrong?
