Serious Crime Bill [HL]

As I tried to indicate earlier, when we looked at the Law Commission’s list, using the same test as for those offences that should not be included, we noticed that there were a number of other offences that the Law Commission, in all its brilliance, had not been able to trawl through. We are now using that same rubric, going right the way through, to see what else should be caught so that we have a complete list. As soon as that is available, we will be happy to share it with noble Lords. I can assure the noble Baroness that the test that we have laid out today will be the test that we will use to examine the offences that should be in the schedule and therefore excluded. We will do some homework for the noble Baroness and other noble Lords so that they can have a more peaceful sojourn, although ours may not be quite as restful.
