My Lords, my name has been mentioned, so I asked my noble friend Lord Howe whether I should seek the leave of the House to say a few words about this amendment. First, it gives no assurance of any form of legal efficacy; secondly, the code would not be enforceable by judicial review and, in the light of certain decisions on education law to which I shall not refer, the clause about resources could be used as an escape clause.
