It may be helpful if I respond to that specific point. Pupil referral units are inspected by Ofsted, but I shall write to the noble Lord and copy to the House the set of measures that we have in place for tracking performance of the pupils whom he mentioned. Section 19(1) of the Education Act 1996, which I have in front of me, states: "““Each local education authority shall make arrangements for the provision of suitable full-time or part-time education at school or otherwise than at school for those children of compulsory school age who, by reason of illness, exclusion from school or otherwise, may not for any period receive suitable education, unless such arrangements are made for them””." I am happy to take further legal advice, but I take that reference to ““suitable full-time or part-time”” as meaning that, where suitable education is full time, that should be the arrangement that the local education authority makes.
