My Lords, I am most grateful to the noble Lord for his response. I can see the logic, as far as he is concerned, of the historical precedent for not having a pre-legislative procedure for Clause 58. Given, however, the crucial role it plays in determining whether Clause 94(2) applies, my submission to him is that the Government ought to think again. In any case, it is, I suppose, thinking aloud, open to either your Lordships’ House or another place or both to develop their own pre-legislative procedure in these matters so that Members of both Houses are better informed when it comes to dealing with the orders that will be tabled in both Houses under Clause 58. In those circumstances, it would probably be not only somewhat unfair but also unnecessary for me to probe this matter further at this stage. Therefore, I beg leave to withdraw the amendment.
