I thank the Minister for introducing the order. These proposals are sensible and we support the order in principle. However, I have questions in just three areas. First, how is it to be decided whether a bankrupt is culpable or merely unfortunate? We agree that there should be differentiation between those who become bankrupt inadvertently and those who have clearly shown culpable behaviour. Although we agree that it is desirable that a distinction is made, it is not always an easy decision to make, there being degrees of culpability. Does the framework now allow for a graduated response?
