There is another reason for the matter to be dealt with urgently. The Barker case did not end the story. The Barker decision remitted the case back to the High Court for a decision on how risk should be assessed between the different parties, presenting an opportunity for a further chain of appeals leading to the House of Lords yet again. It could be many years before we see a resolution of the issue in the courts.
