As for the Tomlinson case, the plain fact is that the lower courts have not responded in the way that the House of Lords expected them to do. I shall be setting out in some detail later this afternoon a case in a court in Manchester that was heard during the Bill’s proceedings in the House of Lords, which illustrates the point.
