Of course they will; that is what I mean by performance management. They will see which trusts are performing badly on healthcare-acquired infections. They will be able to draw attention to that and be in touch with the Healthcare Commission about enforcement action. It will be part of their strategic performance management that they will take an interest in this area. That is not in doubt. It is not required, however, to place legal responsibilities on them in this area, which is focused on the code that impacts on those providing direct patient care.
