My Lords, we have some sympathy with the first part of the new clause tabled by the noble Baroness, which makes specific reference to the Data Protection Act. As she has identified, there is a similar reference in Clause 639. We would certainly be happy to consider that. We may have some difficulty with the second part. There is nothing in the clause to authorise disclosure in contravention of that Act, so we are not sure that such a provision is necessary. However, because we need to consider the first part, we should agree to consider the whole of the amendment and reflect again before Third Reading.
