Safeguarding Vulnerable Groups Bill [HL]

I am grateful to my noble friend for that. I am not entirely sure that it significantly changes the position because, if there is professional concern that the individual may engage in regulated or controlled activity, the local authority presumably also thinks that it is sufficiently serious that the IBB will consider it appropriate for the individual to be included. That is its professional opinion and that is why it has referred the case. However, I take my noble friend’s point that several tests have to be followed. I assume that, in the context of the guidance that will be issued, it will be made clearer to regulated activity providers, to local authorities and to everyone else under what circumstances they should refer professional concerns, and what they need to do to provide supporting material in respect of such professional concerns—those are not in the standard of proof but add to the matters that will be weighed in the balance by the IBB. It would be helpful if my noble friend could indicate that such matters will be covered thoroughly in guidance. If he can give me that assurance, I shall reflect on what he says.
