The local authority must think both (a) and (b)—if my noble friend follows; it must think both that the person is engaged or may engage in regulated activity and it must think that the IBB may consider it appropriate for the person to be included in a barred list. So the local authority—which, as my noble friend said, is a professional body with professional staff—would have to be of the view that the concerns that had been raised were such that it believed it would be appropriate for the person to be included in a barred list. It would have to make the referral in those circumstances.
