The noble Lord said: Amendment No. A208ZAJ relates to Clause 753, entitled ““Meaning of ‘authenticated’””. This is another Law Society point, which we have slightly changed. But we agree with the noble Lords, Lord Sharman and Lord Razzall, over the thrust that we are seeking to achieve. The noble Lords have a parallel amendment on this.
As drafted, it seems that a document or information supplied by a company in hard copy format will be treated as authenticated only if signed by the sender or supplier. The situation where another person signs for or on behalf of that person should also be covered. The wording proposed in our amendment adds an extra safeguard, that the person signing on another’s behalf must be authorised to do so. I hope the Government feel inclined to accept that.
